Terms of Service

1. Acceptance of Terms

By accessing or using any product, service, or website operated by MarSoft AI ("we", "us", "our") — including CrewRef, Voyage Stories, Explorers Hub, CrewPost, Dust Free Film, and Seafarer Capital (collectively, "the Services") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Services.

2. Description of Services

MarSoft AI develops and operates software products for the maritime, superyacht, and service industries. Our Services include but are not limited to:

  • CrewRef — Professional crew reference letter creation, management, and verification
  • Voyage Stories — Interactive voyage documentation and cinematic storytelling from KML data
  • Explorers Hub — Explorer and expedition community platform
  • CrewPost — Yacht crew job postings and recruitment
  • Dust Free Film — Paint Protection Film (PPF) business management and CRM
  • Seafarer Capital — Maritime investment and financial tools

3. User Accounts

3.1 You must provide accurate, complete, and current information when creating an account. You may sign up using email/password or third-party authentication providers (e.g., Google OAuth). You are responsible for maintaining the confidentiality of your account credentials.

3.2 You are solely responsible for all activity that occurs under your account. Notify us immediately at support@marsoft.ai of any unauthorized access.

3.3 We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent or abusive purposes.

3.4 You may delete your account at any time. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

4. User Content

4.1 "User Content" means any data, text, documents, images, files, or other materials you submit to our Services.

4.2 You retain full ownership of your User Content. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, transmit, and process the content solely as necessary to provide the Services.

4.3 You represent and warrant that: (a) all User Content is accurate and truthful to the best of your knowledge; (b) you have the right and authority to submit it; (c) it does not infringe any third-party rights; and (d) it does not violate any applicable laws.

4.4 MarSoft AI does not verify, endorse, or guarantee the accuracy or truthfulness of any User Content. We serve as a platform and tool provider, not a verification authority.

5. Service-Specific Terms

5.1 CrewRef

CrewRef is a document management and sharing tool for professional reference letters. It is not a background check service, employment verification agency, or professional reference-checking company. Verification features confirm only that a document was created through the platform and that the documented email confirmation process was completed. Users should conduct independent due diligence when making employment decisions.

5.2 Voyage Stories

Voyage Stories processes geographic data (KML/GPX files) to create interactive voyage documentation. Route data, coordinates, and waypoints are processed and stored to generate your voyage story. Published stories are accessible via shareable links. Guest book entries are public on published voyages.

5.3 Payment Services

Where premium features or paid services are offered, payments are processed by our payment provider (Polar). By making a purchase, you agree to Stripe's terms of service. All prices are displayed inclusive of applicable taxes unless stated otherwise. Refund policies are specified per Service at the point of purchase.

6. Prohibited Uses

You agree not to:

  • Submit false, misleading, or fraudulent content
  • Impersonate any person or entity
  • Use the Services to harass, defame, threaten, or harm others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools, bots, or scrapers to extract data without authorization
  • Interfere with or disrupt the operation of the Services
  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Reverse-engineer, decompile, or disassemble any part of the Services
  • Circumvent any access controls, rate limits, or security measures

7. Intellectual Property

7.1 The Services — including all code, design, branding, logos, documentation, and proprietary technology — are the property of MarSoft AI and are protected by copyright, trademark, and other intellectual property laws.

7.2 You may not copy, modify, distribute, sell, or create derivative works based on the Services without our express written consent.

7.3 "MarSoft AI", "CrewRef", "Voyage Stories", and other product names are trademarks of MarSoft AI. You may not use them without permission.

8. Disclaimer of Warranties

8.1 THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.

8.2 We do not warrant that: (a) the Services will be uninterrupted, timely, secure, or error-free; (b) results obtained will be accurate or reliable; (c) any User Content is truthful, accurate, or authentic; or (d) defects will be corrected.

8.3 Any reliance on User Content, including reference letters, voyage data, job postings, or other user-submitted information, is at your own risk.

9. Limitation of Liability

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARSOFT AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Services
  • Any User Content, including reference letters, job postings, or voyage data
  • Unauthorized access to or alteration of your data
  • Any decisions (hiring, employment, financial, or otherwise) made based on information from the Services
  • Inaccurate, fraudulent, or misleading User Content
  • Any third-party conduct on the Services
  • Service interruptions, data loss, or security breaches

9.2 IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED EUROS (€100).

9.3 Where Services are provided free of charge, you acknowledge that the limitations above are fair and proportionate.

10. Indemnification

You agree to indemnify, defend, and hold harmless MarSoft AI and its officers, directors, employees, agents, and affiliates from all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any decisions made in reliance on content from the Services.

11. Service Availability & Modifications

11.1 We may modify, suspend, or discontinue any Service (or any feature thereof) at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

11.2 We are not liable for any downtime, interruptions, or discontinuation of Services.

12. Termination

We may terminate or suspend your access to any Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 13 survive termination.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Greece and the European Union, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Services. Your continued use after changes are posted constitutes acceptance.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MarSoft AI regarding the use of our Services.
